Terms of Service

Welcome to Cartoix. These Terms of Service ("Terms") govern your access to and use of the Cartoix website, mobile applications, APIs, and online creator tools (collectively, the "Platform").

By registering an account, importing products, promoting listings, or using any services provided by Cartoix, you agree to be bound by these Terms. If you do not agree, you must immediately cease all use of the Platform.

By using our Platform, you represent that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the full legal capacity to enter into a binding contract.

If you are agreeing to these Terms on behalf of a company, partnership, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

You may only use the Platform if you are not currently barred from receiving e-commerce or financial services under the laws of the United States, your country of residence, or any other applicable jurisdiction.

Cartoix reserves the absolute right to refuse service, terminate accounts, or restrict access to any individual or entity at our sole discretion.

To access certain features, including creating store profiles, adding products, or generating affiliate links, you must create a verified creator account.

You agree to provide accurate, current, and complete information during the registration process and to keep your account details updated at all times.

You are solely responsible for maintaining the confidentiality of your credentials (username, password, and two-factor authentication keys).

You agree to notify Cartoix support immediately of any unauthorized access or security breach. Cartoix will not be liable for any losses caused by unauthorized use of your account.

All users must operate in good faith. You agree not to manipulate product pricing, artificially inflate review scores, coordinate fake purchases, or use automated systems (bots, scrapers) to interact with the Platform.

You agree not to bypass any security measures, access restrictions, or content filters implemented on our web and mobile applications.

The Platform may only be used for lawful purposes related to legitimate e-commerce, dropshipping, digital creation, and affiliate marketing.

Any use of our infrastructure to distribute spam, malware, phishing links, or unlicensed promotional content is strictly prohibited.

You may not engage in activities that cause harm to other creators, customers, or Cartoix staff. This includes harassment, defamation, intellectual property theft, fraud, and misrepresentation.

Engaging in wash trading, self-purchasing to claim commissions, or laundering funds through store layouts will result in immediate permanent ban and forfeiture of earnings.

Sellers and creators must ensure all listed products contain honest descriptions, transparent shipping timelines, accurate sizing, and realistic images.

You must not list items that infringe upon third-party trademarks, patents, or copyrights. All products must comply with the Prohibited Products Policy.

Every order placed through a Cartoix storefront constitutes a transaction managed through the Platform.

Sellers are legally responsible for fulfilling orders as described, providing tracking details, and managing customer service issues.

Cartoix integrates secure payment gateways (including Stripe and authorized card networks) to process customer payments.

By transacting on the Platform, you authorize Cartoix and our payment processing partners to collect customer funds, process transactions, and deduct applicable platform fees.

The payment lifecycle operates as follows: Customer payment → Stripe/payment provider → creator earnings remain Pending Earnings → standard 7-day operational Settlement Period → eligible funds become Available Earnings → Payout executed via Stripe Connect → creator's linked bank account.

Cartoix charges platform service fees, transaction fees, and commission shares as detailed on our Pricing page.

Creator earnings remain classified as Pending Earnings during a mandatory 7-day operational Settlement Period from the transaction date. Pending Earnings reflect recorded sales but are not eligible for Payout until release conditions are satisfied.

The 7-day Settlement Period is an operational release and risk management mechanism. It does NOT constitute a legal escrow account or a regulated stored-value wallet. Available Earnings represent the creator's eligible earnings balance.

Cartoix reserves the right to delay, withhold, or restrict Payouts where permitted by this agreement because of customer refunds, order cancellations, credit card chargebacks, fraud investigations, identity compliance reviews, payment-provider restrictions, or other legitimate operational reasons.

You are solely responsible for determining, collecting, reporting, and remitting any sales tax, VAT, GST, or income tax applicable to your sales earnings.

Cartoix may collect Taxpayer Identification Numbers (TIN) and issue annual reporting forms (such as Form 1099 or Form 1042-S) as required by international laws.

The Cartoix brand, logo, codebase, visual layout, and proprietary technologies are the exclusive property of Cartoix and protected by global copyright and trademark laws.

No user may copy, modify, distribute, or reverse-engineer any portion of the platform without our prior written consent.

By uploading logos, banner images, product designs, or reviews to your storefront, you grant Cartoix a non-exclusive, worldwide, royalty-free license to host, display, and distribute this content.

You represent that you own all rights to the uploaded media and that it does not infringe on third-party intellectual property.

Cartoix reserves the right to suspend or terminate your account, remove listings, or apply Payout Holds on pending balances if you violate these Terms or present a financial or security risk.

Upon account termination, your right to use the Platform ceases immediately. Provisions regarding liability, indemnification, and governing law survive termination.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

CARTOIX DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, TIMELY, OR ERROR-FREE, NOR DO WE GUARANTEE ANY SPECIFIC LEVEL OF REVENUE OR SALES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARTOIX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, OR DATA.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO CARTOIX IN THE PRECEDING THREE MONTHS.

These Terms and any disputes arising out of them shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles.

You agree to submit to the exclusive jurisdiction of the state and federal courts located in Wyoming for resolution of any legal proceedings.

We may update these Terms from time to time. When changes are made, we will update the "Last Updated" date and notify creators via the dashboard panel or email.

Your continued use of the Platform after changes are published constitutes your acceptance of the updated Terms.
